Independent Contractor Agreement

A contract for hiring someone to do work as their own business, not as an employee.

Good for: Business owners and freelancers who want the job, the pay, and who owns the work in writing.

Before you sign

  • Whether someone is truly a contractor depends on the facts of the working relationship, not just on what the contract says. Contractors set their own hours, use their own tools, and may work for others.
  • The client usually does not withhold taxes from a contractor's pay. The contractor handles their own taxes.
  • The client may need to send the contractor a tax form at the end of the year if the contractor was paid above the limit set by law.

What this is not

These are standard forms for you to fill in, plus plain-language information. This is not legal advice and this site is not a law firm. We do not file anything for you or check your answers. Rules differ from state to state, so read the finished form before you sign it.
